    Are drillers exempt from the Migratory Bird Act? What are the survival chances of, say, a whooping crane that stops there for a drink? Many other birds also use North Central Texas as a migratory pathway, not to mention all the others that live in the area.

    Apparently birds die in pits all the time. Look here and scroll down a bit. I called the TRC last year about it and they don't have to fence or cover the pits at all.

    Look past that pit to the tree line downhill. That's a flowing creek that feeds into Denton Creek.

    Well, ~$900 has to be the cheapest possible violation of Federal law. Might as well be exempt.

    We are working on a campaign to get better pit rules in Texas. Not that we need them are anything…

    The fines are ridiculously low and I think a permit to drill is only about $200.

        In Texas they don’t require that pits be lined or fenced. We need to change that so the more photos and evidence I have the better the chances.

    omg this makes my heart sick. Devon had runoff to a creek beside our home , I called the EPA they sent a guy out and I video taped the visit, he talked to a gas guy shook hands then left. they repaired the dam around the pond but never cleaned up our property or the creek and argued with me saying they did, not true video tapped the whole thing! they get away with murder!
